Ten years were to pass before Martin and Magdeline again agreed to be interviewed by a reporter.

Within days, Ole Stolen prepared a document on Johnson’s behalf and sent it to Governor Blaine in his capacity as chairman of the Committee for Compensation of Innocent Men Who Have Been Wrongfully Imprisoned. In it, Stolen excerpted the most favorable portions of Commissioner Rufus Smith’s findings:

There is only one fact that stands out clearly, and that is that Johnson did not murder Annie Lemberger.

Your petitioner [Johnson] further respectfully represents that he was wholly innocent of the offensive charge, and free from any knowledge thereof directly or indirectly, and was wrongfully arrested, imprisoned and convicted... .

Your petitioner further respectfully represents that he is an expert electrician by trade and is fifty-eight [actually he had just turned fifty-five] years of age and while so wrongfully arrested and imprisoned could have earned and was capable of earning at least $1,500 per year.

Your petitioner further respectfully represents that he has suffered damages by reason of such arrest, conviction and confinement, in loss of property and loss of earning capacity, all of which has caused much humiliation and mental suffering which in the aggregate is not less than $5,000.
